About the Office:   
This job opportunity is in the rulemaking/administrative law section of the DOT General Counsel’s office.  DOT, by some measures, is the largest regulatory agency in the Federal government.  The Department’s regulatory responsibilities cover a wide range of subjects, including safety, environmental, and civil rights, that raise important legal and policy issues. 

The office is the focal point for the review and coordination of regulations drafted by the Department.  It provides advice to senior officials throughout the Department on the broad spectrum of administrative law issues.  There is extensive contact with senior DOT officials, Congressional staffs, OMB, and other Federal agencies, interest groups, and the public. 

Major Duties:   
The incumbent is responsible for rendering expert legal assistance to the Assistant General Counsel and other officials within the Office of the Secretary and DOT operating administrations on regulatory and administrative law matters. Although all attorneys in the office are called on to work in a variety of subject matter areas, current needs may lead to some emphasis on issues involved with aviation activities.

Often, matters handled by the incumbent will be of a difficult and complex nature, requiring a thorough analysis of issues and sensitivity to conflicting concerns.  The incumbent needs to take into account economic and policy factors involved in rulemakings, as well as legal issues. 

The incumbent will perform legal research and analysis; conduct needed conferences and consultations; prepare memoranda, correspondence, and opinions; and maintain continuing liaison with officials and organizations involved in the regulatory process.  The incumbent renders not only written advice, but must also present oral advice or information to supervisors within the Office of General Counsel, other DOT officials, and outside parties.

Additional Qualifications: 

Selection Criteria:   

  • Candidates must be citizens of the United States, must possess a law degree (J.D. or LLB) from a law school accredited by the American Bar Association (ABA) and must currently be a member in good standing of the bar of a State, a Territory of the United States, or the District of Columbia.
  • The position requires excellent analytic, writing, and editing skills, as well as excellent oral presentation and advocacy skills. 
  • The incumbent should be able to deal diplomatically with individuals from diverse backgrounds, sometimes with conflicting interests, and should be able to handle multiple projects and issues simultaneously and in a timely manner. 
  • A background in transportation law, regulations and administrative law, and/or administrative agency practice is a plus, but is not required. 
  • A sense of humor and an ability to work well with people, often under tight deadlines are very useful in the position.
